Employer Want Me to Pay Vacation Pay Back

My question involves employment and labor law for the state of: Michigan

I worked enought hours to earn my vacation, got it approved and used it. When I was due to return to work, instead of going back I had found another job and quit. I read through our handbook and it says nothing about this issue, only that vacations need to be approved before taking. Now they want me to repay it. Can they do this?

And please, rebeka, show us the law that allows the employer to require repayment of earned vacation. The poster clearly states that he had worked enough hours to earn the vacation.

I do know what you're getting at, but it doesn't apply in this case.

i have a similar issue~ i quit my job and my employer gave me a check for 0.00 and said i needed to pay for the vacation time i used last dec. They say you earn your 1 week vacation after 1 year, but they claim that if you quit or are fired before 2 years is up then you owe them for the vacation time they gave you. Can they take my money?

At the very least, you are owed minimum wage times hours worked. Your state may or may not allow for the repayment of unearned but taken vacation; you'll have to ask your state DOL that. But he cannot legally give you a zero check.

State is michigan, im going to do some MI DOL research all weekend and pending what i find i will call them on monday and see where i go from there. Thanks for your help
