Can You Really Lose Your License for Minor in Possession of Alcohol

My question involves criminal law for the state of: California
About a month ago i was given a citation for MIP (B&P 25662(a)). I wasn't near a car, I was on a beach boardwalk. the container was unopened as the officer even stated on the citation and it was charged as a Misdemeanor.

I've asked several police officers and they've all told i wont lose my license at most i'll get a fine and community service, But i keep reading on the internet I may lose my license up to a year.

Can anyone give me insight on this situation please?

Yes, you really can lose your license. I'm not saying you WILL - that will be up to the judge. But you CAN. The law provides for that option.

The time to worry about that was before you broke the law. Whether you do or do not lose it is now no longer within your control.

If you lose your license, there are things called Public Transportation, Taxi, asking Mom or Dad or a friend for that ride....

How do I go about asking the judge about a diversion program?
I am going to plea guilty, but I can't afford an attorney to set up a diversion program or another alternative

The Vehicle Code states that if you are convicted of B&P 25662 "the court shall suspend the person's driving privilege for one year." If suspended, you can petition the court to allow for a restricted license assuming you can show a "critical need to drive."

You might want to look into diversion options as suggested. And you might be permitted to ask the judge about this ... you might not. Each court can behave differently. Perhaps you can seek some free consultations with local attorneys or see if there is a legal aid or bar Association group that can offer some free or low cost advice to you on how to proceed.
