    Default Can You Still Be Fired After Being Laid Off and Given 30 Day Notice

    My question involves labor and employment law for the state of: TX

    Can you still be fired after already being "laid off" and terminated without cause and given a 30 day notice? Can they change or amend the termination or fire you during/within the 30 day period? (just outright fire you without any pay-out or buy-out)

    Any thoughts?

    Of course, unless you have something in writing that clearly states that you will not be fired for any reason whatsoever within the 30-day notice period.

    As per the contract you must be given a 30 day notice if you are being terminated without cause. And if there is a possible cause for termination the contract states that you need to be given chance to remedy this within 30 days.

    What contract - please explain as there are so many different types of contracts that I can't give you an accurate answer without knowing what this is. Also, it would have speeded things up no end had you mentioned the existence of a contract in your first post.

    employment contract states that both employer and employee can terminate said contract without cause as long as you give 30 days notice. the signed contract is for one year. it has been only 9 mos but employer did terminate contract without cause and has given it's 30 day notice (employee was "laid off"). now during and within this 30 day "grace period" that the employee is still under contract and employed, is it possible for employer to amend or change the initial termination (without cause) and fire the same employee?

    I appreciate your help and response, worry if the post/question is a bit confusing.

    Whenever there is a contract involved, the only really accurate answer will come from someone who had read the contract. The law does not prohibit an employer from firing an employee after they have been laid off. So this is really going to depend on what the contract says, and I can't read the contract from here.

    Does the contract address being fired within the 30-day notice period. I know you said something about this previously but is that all it says?
