He won't get a 50/50 timeshare, living out of state (even if it's the top part of DE and the bottom bit of NJ). He can pursue a regular, enforceable visitation schedule though.

Does the father understand that joint custody is NOT synonymous with a 50/50 timeshare?

he would be able to get 50/50 timeshare. If both parties are financially and mentally stable with a stable living environment then they are BOTH entitled to equal rights to the child(and i know this because I live in Tx and my daughters dad lives in louisiana) its all gonna depend on the judge. i would take the papers to a lawyer just to get the ball rolling and get things settled in a timely manner for the sake of the child.

And this is relevant to the OP's states...how?

A 50/50 timeshare is NOT generally feasible once the child is in school. This has nothing to do with parental fitness.
