At-Fault Driver's Insurance Says Coverage Was Canceled Prior to the Accident

My question involves a traffic that occurred in the state of: CA. I was in an accident5/9/12.not my fault. I filed a claim against the ins co of car that rear ended me. I spoke to manager of Adjusters today and he's trying to tell me the car owner cancelled their ins before the accident. I thought if u cancelled an auto policy you had to have proof of new coverage. The mgr is stonewalling me. They have already transferred me from original adjuster to another this morning. Which gives them another day to contact me. My car is inoperable. Infinity Insurance is trying to play with me. Please help!

If the car was not insured, it was not insured. A car owner's former insurance company does not have to pay for accidents that occur after coverage is terminated. There is no law that extends a canceled insurance policy until such date as a car owner picks up new coverage - if you want insurance on your car you must contract for insurance and pay for that coverage.

If the at-fault driver misrepresented the state of his coverage to the policy, you can try to follow up with the police to see if they'll cite him for driving while uninsured.
