    Default Info Given to Other Person About Pawned Item

    My question involves a consumer law issue in the State of: SC.
    My brother in law is saying that a pawn shop emailed a video andpawn information that my son in law had pawned a ring that didnt belong to him.
    As we have not dealt with this pawn shop, and my brother in law has yet to show us proof of anything, my question is, can a pawnshop send video out to just anyone who calls and can they give information of the customer to a person who just asks? My son in law swears he has never pawned a rinb.

    I have no idea how the pawn shop got the email address.

    From the little info in your post, I would think that there might be a concern with identity theft.

    In any case, NOBODY has any claim against the pawn shop. The entire thing on Constitutional rights only applies to government, not private parties or entities. There has to be a tort statute they have violated and there isn't any.

    No idea about SC, but here in Florida, pawn shops have certain duties and rights to determine if an item is stolen.
    Also, what many people do not realize is that the police can't take the stolen item from the pawn shop. The pawn shop is an innocent holder in due course and gets to keep the item. Bet you didn't know that. If the owner wants it back, they have to make a private deal with the pawn shop, like paying the amount pawned out at minimum.

    Perhaps the pawn shop thinks the item is stolen and wants to confirm the identity of the person in the video and maybe they are trying to be good citizens.

    So, the short version to your question is YES.
