    Default Can the Police Question You If You're Intoxicated

    My question involves police conduct in the State of: new jersey. can u be questioned and read ur rights and arrested if you tell the officer that you are under the influence and dont even know whats going on and they continue anyway.

    Yes you can. You and your lawyer are free to argue that you were so intoxicated that you could not knowingly waive your rights.

    I don't know how they do it in NJ, but here in Indiana the judicial officer will also read your rights at your initial hearing once you sobered up. As far as the police are concerned, there's no time like the present.
