    Default Discrimination during and after pregnancy

    Okay so I have recently moved on from this employer and I am still very hurt but their lake of professionalism, It was all I could do to get another Job in the same line of work.

    So what happened It started while I was pregnant I had several opportunities to advance from my current position as an assistant manager of a small apartment community with this company to an assistant manager at larger communities. some of the positions were filled by other assistants but at least two of the positions were filed by leasing agent (who didn't have the experience or title I did). I was wondering if I could still do something about that?

    Secondly I had decided after giving birth to my son that we were going to move to Louisiana to be closer to family. So a few months after starting back to work we had the finances available to move and I gave my notice 3 weeks before we were going to move. During the next two weeks thing seemed fine Then one day when my manager was off the grounds guy had stolen one of my sodas from the refrigerator (this happened often!) So I confronted him about it in my hast of confronting him I had slapped his hand. The next day my manager and the regional manager and HR lady sat me down and fired me, saying that this was unacceptable behavior (Which I know). However I have exit paperwork that states they are letting me go in lue of my notice and nothing about the incident from the previous day. I Also was never written up for any infraction other then being late once. They now have me listed as fired and not rehire able which has caused me several difficulties in getting a job.

    Would I have any kind of case against the company?

    You were fired. As a result of being fired, you are not eligible for rehire. If the employer has that listed, it is correct information. I see nothing illegal in your employer's action.

    When did you have the advancement opportunities? When was the last opportunity filled? Why do you think your pregnancy had anything to do with your not getting the job?

    I had several advancement opportunities 4 to be exact they were all when I was about 5 month pregnant that would have been in sept last year. I know that I was over qualified for these positions because just before that I ran our office as the manager for a month then people whom never even had assistant experience or manager experience were placed in the position. Also they posted for positions then just filled them without interviewing is that normal? I am just trying to see if there is anything wrong with there practice when I was pregnant

    Many employers will not hire someone who is overqualified for positions because of the (very strong) likelihood that they will grow bored and leave. There is nothing illegal or discriminatory about that.

    There is no law requiring them to interview applicants before hiring.

    So far, you have posted nothing to suggest that your pregnancy had anything to do with their failure to promote you.
