    Default 3 People on a Deed, 1 Deceased

    My question involves real estate located in the State of: Texas

    Four relatives own equal shares of a non-homestead property, and one of them dies intestate. What happens with the remaining three in respect to any issues that may arise with the property, that would normally require all four signatures (such as a home equity loan to cover major repairs)? Could one of the heirs of the deceased co-owner force a sale of the property if they wish?

    You don't state the form of ownership. Was it tenants in common? Or joint tenants with right of survivorship?

    If tenants in common, then, yes, one of the heirs of the deceased could file a partition suit to force a sale. If the other 3 co-owners do not wish to see that happen, they should begin thinking about an offer to buy the deceased co-owner's share of the property.

    Yes, it is simply tenants in common. Thank you for your help. We will seek to determine a reasonable offer amount.
