    Default Child Protective Service Took Child from His Mother

    My question involves child abuse or neglect in the State of: Iowa
    My son received a letter from CPS advising his son had been taken from his mother. My grandson is disabled he doesn't walk or talk. He has a muscular disorder & wears pampers he's 5-years old. The letter said he was removed because he was denied critical care, negligence and abandonment. I told my son to respond to the letter & let them know he is interested in getting custody of the child. What else should he do? I live in North Carolina if for some reason my son can't get the child could I try to get him? I know there's a possibility the courts will try to give the mother another chance perhaps with supervision. I just need to know our options.

    If this is the first time anything like this has happened - and it's difficult to gauge the severity - there's a very good chance Mom will be allowed to follow a plan to be reunited with the child.

    Perhaps a big question is, how much contact does Dad have with kiddo? Is he legally established as father?

    He does need to contact CPS, and at least find out what's really going on.

    Paternity has been established. When they broke up the mother didn't let him see the child. The mother doesn't want any of us to be in his life. I thought that was crazy because we could help her with him. I know my son has rights & I've talked to him about the serious responsiblity involved with taking care of a child with special needs child. I've worked as a respite parent, I've ran a special daycare for children with special needs. I've also worked with DHS & CPS. I know how the courts work. Reuniting the parent with the child is always first priority when appropriate. I've always had concerns because the mother is not mentally sound I guess I was hoping her family would help her with him. I'll let you know more after my son talks to CPS.

    Well, it's always been up to Dad to file for an enforceable visitation plan. If he didn't - it's not really fair to blame Mom 100%.

    Dad should speak with a local attorney. You have no standing at this point to do anything other than help him find one.
