My question involves the possibilities of court allowing grandparents doing a co-adoption with the custodial parent on the custodial parent's children. I am married, working towards divorcing my wife as we speak. A few years ago DHR took our children from us and placed them with my parents. DHR required that my wife and I completed a drug program and counseling to get our children back. Immediately my wife and I split. So we both were supposed to through this process, I completed it and she didn't. So after completion of the program I attended the court hearing and was awarded full custody of the children and my wife failed to stay in compliance with the requirements and lost her parental rights. Then she went into a downward spiral. She has become an escort, openly admits she is still on drugs, and lives out of hotels. Childsupport has not been ordered yet, but I am filing for that soon as well. My parents did have guardianship of my children until I got full custody. They still help me so much and have been a big part of the kids life. Now I am receiving threats that she is gonna petition for visitation of the kids (if she ever get up the money). DHR told her she will have to get a lawyer to do it and more than likely she will still get the option to do the program she blew off before. She has ads of her "job" online and does not plan to stop doing it any time soon and I fear that if she petitions the court for visitation, that they will give her visitation of the children. They are scared of her because of what they have been through. I have changed dramatically into being a good parent and is my #1 priority to never fall back into that situation again. So I wanted to know since I am the custodial parent and she does not have rights with the children nor visitation, can me and my parents petition the court for allowance of a "co-adoption" between me and my parents to where I still have custody and my parents would have custody too at the same time? Also for this particular situation, since my wife does not have custody, will I still have to have her permission for the adoption if it is possible? It has been almost 2 years since this happened.
