    Default What Constitutes Child Abandonment

    My question involves child abuse or neglect in the State of: Illinois
    My friend's girlfriend left him with 2 children and stated to him that she met someone and they could not begin their lives together with children so she was giving my friend the children. She even agreed to notorize a paper giving him the children. The oldest is 6 years old and my friend is not his biological father but was there for his birth and has raised him, the youngest is almost 5 and my friend is her biological father. She has been gone since February 26, 2012 and has since stated that she does not want to take custody of the children but that she is not going to notorize papers for him either. What can he do? is this considered abandonment? This is putting a hold on the 6 year old going to school, since my friend is not the biological father he can not legally put him into school. He has told her this and she does not seem to care.

    The children aren't abandoned. The mother left them with your friend, who is the father to one of the children and who is willingly caring for the other.

    Your friend can seek custody of his own child. Your friend can seek guardianship of the other child. There is no excuse for not enrolling the six-year-old in school. If your friend can't step up and get it done, he can consider allowing CPS to place the child in foster care so the child can get an education.
