    Default Do I Have a Good Cause Resignation Case

    My question involves unemployment benefits for the state of: MIchigan

    I worked in an a very small office of 4 employees. I worked there for 5 years. I enjoyed my job, was a top performer and received alot of awards and accolades from the company BUT I could no longer tolerate the other staff. You can only tolerate abuse and harassment from co-workers for so long. It was being overlooked by the manager. They made sexual comments back and forth almost daily. I mostly ignored these comments or just rolled my eyes at them. If I did make a comment to let them know it was offensive they just told me to lighten up. When I brought this to the managers attention he ignored it. I told him he was missing alot in front office and he state he wasn't, so he HEARING it but just wasn't doing anything about it. The manager actually made comments at times as well. One in particular was when my youngest daughter visited me at the office. He thought she was really hot and if he wasn't married he would like to date her. INAPPROPRIATE!! As long as we were getting our work done and he was getting a bonus that was all that mattered to him. In my discussion with him about the situation he said if he could fix it, the situation would just return again. I put up with this for a long time (5 yrs) because I was good at my job, enjoyed the work and the satisfaction of helping my customers rebuild their credit. I continually earned awards with the company and was consistently ranked in the upper third of may area and district. On Friday April 20th, one of the employees got mad when I told him I was sick and tired of their continual snide remarks and comments. He state to me that is was to bad, no one in the office likes me anyway!! Later that day I put in my one week notice.
    These kind of lewd comments don't belong in an office and I made my decision that since it was being allowed that I was no longer going to subject myself to the situation.

    It's a pity that your employer didn't take steps to stop the inappropriate comment. However, since the company has less than 15 employees, Federal laws against sexual harassment do not apply. You're in luck, however, that Michigan is one of the states with a lower floor for discrimination/harassment laws, so if you care to make a complaint at the state level to the Michigan Department of Civil Rights, you might be able to take some legal action.

    As for unemployment, this might qualify and it might not; only the state UI commission can say for sure. But since you've already quit, the best thing to do is simply apply. There's no penalty for being wrong, and it doesn't cost anything but a little time. The worst that can happen is that they say no, in which case you're no worse off than if you never filed in the first place.
