    Default Who is Allowed to Stay in Home

    My question involves estate proceedings in the state of: Virginia
    My question is who is allowed to reside in home once a Deed of Gift with a life estate is established in virginia? Other people are staying in the property and i want them out? I was deeded the property, and my grandmother owns the life estate? She has not and don't plan on selling the life estate, but my cousin and her son stays in the home and i want her off my property. Without a transfer of the life estate is anyone else allowed to stay in the home?

    well, who stays in the home is up to your grandmother. For all practical purposes, a life estate is nearly identical to owning, along with the most of the rights afforded ownership. You have no control over who stays in the home. Your grandmother can allow or refuse anybody the right to stay in the house.
