    Default Boyfriend Came Here Illegally with Parents as a Small Child

    I want to get married to my boyfriend. I'm pregnant with his children(twins) plus he has another son. We want to try and get him his green card & eventually complete legal status. I've researched and researched and I haven't found any situation close to mine/his. He came here illegally with his parents when he was 4 years old. And they never applied for a visa. He just turned 18 last July. I've read about people that just overstayed their visa getting it easier than people that came here with no visa. But I'm not sure if it would help at all , since he had no control over coming to the U.S. Is there anyway they will still let him stay in the U.S? I will be moving in soon and the twins & I will be completely dependent on him. Sorry if I'm not explaining well , I do better with my words when I actually speak. Thank you in advance for ANY advice I can get.

    You haven't researched very hard, as there are many questions just like this one in the forum.

    He entered without inspection, so he's ineligible to adjust his status (he has no status to adjust). He started to accrue unlawful presence last July, so he's past the 180 day mark (3 year ineligibility to reenter) and headed for the year mark (10 year ineligibility to reenter).

    We don't know anything about his nation of origin, but depending upon what it is he may be eligible for asylum. Realistically speaking, all we can do is suggest that he consult an immigration lawyer, without offering much reassurance that he won't be required to return to his nation of origin, or that he will be eligible for a waiver that would allow him to reenter before his period of ineligibility expires. But the longer he waits to try to resolve things, the more difficult it's likely to become.

    I just made my account today. But I meant from other sites.

    Okay , so as of now He will be gone for 3 years? Will that be waived if I file for financial hardship?

    He is from Mexico , my dad took him about a month ago to speak with a lawyer , but I feel she didn't explain much - well judging by what my father and boyfriend told me about it.
    Also , about how long will it take to get a marriage licence/certificate? Would we be able to get it before July?

    Don't mind my last question about the marriage license - I found that out myself.

    Since he cannot legally work, he cannot support you and the babies. He does not likely qualify for a waiver simply on the basis of finances. You would be expected to meet the income levels for his sponsorship yourself - an income of about $30,000 per year.
