    Default Fiancée's Status After Failing To Marry Within 90 Days

    My wife of just two-and-a-half months left me about 2 weeks ago.

    She is from Colombia, here on an expired K1 visa. We got married within the 90 day required period. We've had a few arguing/ difficult issues and she claims to be "afraid" of me.

    Now I find out that she is seeing an attorney tomorrow, presumably, to see if she can get some kind of permanence here. I currently have been unable to change her status (I-485) because I'm currently unemployed.

    My question is this... what chances does she have to get residency here on her own?

    I don't want to get her deported, as I want to reconcile, but she is making no moves towards that. I figure she is out of status, having left the home.

    Do I have any grounds to get her deported if necessary? Right now I feel very very played.

    We don't know what her claims will be. If she's claiming domestic violence, she has a chance. If not, odds are she needs to be thinking about packing her bags.

    The decision as to whether or not she remains in the country is not yours.

    Well, the truth is this. She was up on a misdemeanor charge of domestic violence. This was subsequently dropped. Frankly I was pretty verbally mad at her (because of stress etc).

    I do have some anger issues, but I am dealing with them.

    If she did claim domestic violence, how could she stay?

    BTW - I am currently making sure she gets money to live etc, and I just paid for her next level of English class at her college.

    THIS IS NOT THE CASE - we were married within the 90 day period.

    Just wanted to clarify that.

    Not sure if you understand.

    SHE was arrested and charged with misdemeanor DV. I refused to cooperate and the charge was subsequently dropped by the DA.

    Any further comments?
