    Angry Summer Vacations

My ex and I already went to court over this and the kids are supposed to go to his house this summer (we live in WA now). Why can he lie in a court room about where he lives and decide after 2 years of NOT taking ANY Visitation and I'm expected to let them go? He doesn't live where he claims to and I have proof of that. Can I do anything about this? I'm not going to just let my kids go to some random place because he lied and got away with it.

    You mean he moved?

Yes, you're going to let your kids go with Dad per your court order. Or, he can take you to court and ask that you're held in contempt.

No he didn't move he flat out lied about where he lives.

And we're not talking about some visit where they are even going to be remotely close. He lives across the country. This is 8 weeks of them being at a place that is different than the address he gave to the court that day! He lied to the judge's face and the address he is lying about is notated on the court order. So basically he can lie and say he lives anywhere he wants and I'm supposed to blindly drop my kids off right? I'd rather be held in contempt than give them to him and he takes off with then anywhere he wants just cause he was able to bs a judge.

you need to consult your lawyer about this are they flying alone? someone coming to get them? you taking them. i would talk to someone is there a plan that says you have to give him the kids across the country, if the plan states his visits are here in wa then you dont have to send them anywhere across the country

Sigh. Doing this is going to land Mom in a world of trouble.

Because you know what? The courts don't CARE that the NCP doesn't live where he says he doesn't live (in the same state - which IS the case here, I believe? Dad has been out of state awhile, yes? And it's just that you've found out he doesn't live at the same place he stated in court? That's the case, yes?).

They TRUST the NCP because the CP TRUSTED that person to be an adequate parent when they had a child with that person. The court will trust the CP's decision until proven otherwise - and something as trivial as Dad not living where he said he was living, is not going to impress a judge if that's all the CP has to complain about.

rysmamma, it's very obvious that you don't have much legal knowledge - PLEASE, for the sake of everyone else, read more and post less, okay? I'm trying to be as kind as I can when I say that.

You need to send the children or you could potentially lose custody as the PC. If they see the primary giver is not able to provide a healthy relationship between the child and the NCP that could be enough of a reason to switch the roles. If you had issues with these things then they needed to be brought to the court attention way prior to 30 days before the summer visit.
