    Default Statute of Limitations on Property Damage Caused in a Car Accident

    This all takes place in Austin, TX

    Almost 3 years ago I was involved in a traffic accident with a car being driven by a carmax employee to the carmax lot. It was 100% my fault. At the time, my insurance had lapsed (I was unaware), so I was uninsured. I was cited for no insurance, and nothing else. Not knowing what to do, I just waited to hear from a lawyer, or from the company, telling me how much I owe, so I could pay it, but nothing came.

    On Friday, I was received a voicemail from an attorney's office in Houston saying they were going to file a lawsuit in my county with the recommendation that my license be suspended. I figure they would be suing me for property damage, but the statue of limitation on property damage in Texas is two years, and that has passed. The driver of the other car wasn't injured, but injury lawsuits are also 2 years.

    Am I missing something? Is there still something they can sue me for?

    Do you also live in Texas, and have you lived there consistently over the past @3 years? Perhaps they're looking for a way to toll the statute. Perhaps the lawyer didn't check the dates carefully, or is seeing if he can shake some money loose without actually filing a lawsuit.
