    Default Canceled Sale After Setting Up Payments

    My question involves a consumer law issue in the State of: Missouri

    Haha, another Kirby horror story. I am so afraid they will start charging us for the vacuum. I would not mind so much if we actually had the machine because I had one growing up and I do like the vacuum. But after "talking to his boss" we got the price knocked down with no down payment. We filled out their form (not sure if that was the contract or not it did list our account number on it and they asked for a voided check for the auto payments, and a postdated check for the first payment. I never got him the checks.) and my husband talked to the finance company on the sale's man phone they asked questions like "is the machine at your house the one you will be keeping?" And asking if there was any downpayment. We were approved and everything like that but the sales man said he needed his supervisor to help him with the paperwork. Supervisor enters and then I dont know what events transpired but all of a sudden the distributor said they could not give us the vacuum without a down payment so the sale did not go through according to the sales people. Now I asked if we had to do anything with the financial company to stop the already set up payments. The sales man said "no you dont have to do anything" The other man said "we will take care of that for you" I am not good at standing up for myself (pretty weak and timid) so I wanted to tell them "call them right now so we can cancel" But I was just too afraid to speak up. And I fear that was our fatal mistake. I dont have any contact information for these people (usually sales people like this leave you anything they can with their name on it so they can have you think of them for more sales) But I have not even a first name. There is just so much strange about this that I am afraid the payments are going to go through even though we dont even have possesion of a vacuum from them and the sales team said we could not have it without a down payment according to their distributor. Because we signed that peice of paper (again unsure if that was the actual contract) are we finacially ruined? Is there anything I can do to make sure this will not happen for peice of mind.

    If you didn't buy the vacuum, and everybody is in agreement that the sale did not go through, make sure your bank is aware that you don't authorize any charges from the finance company.

    if you did not submit a down payment then most companies cant charge you because in order for the deal to be set would be for them to have that down payment. i have a similar issue with comcast i thought the contract on my other service was done found out it wasn't but because i didn't submit a down payemnt or sign for the service when the tech dispatched out here the deal didn't set.

    Sorry but her comes a little vulgarity, if you are a man then ball up, if you are a women then grow some lady balls, no offense but if you are too timid to stand up for your and i emphasize the word *YOUR* money then you will lose a lot of money in your life, you need to understand the contract, truthfully you should know that contract better then they do when they leave, its your job to stand up for yourself because they won't all they want is your money they won't tell you about the hidden clauses or secrets to their contract you must read up on that.

    Now about the charge, call your bank and verify that you are under the impression that they will not be charging you and have them watch your account and stop any charge they attempt to do, if you have a large chain bank ie uccu then they will do this free of charge, if you have a small chain bank then you most likely will have to pay for it.

    here is my last touch of wisdom, do not buy stuff from door to door salesmen under any circumstances, i have had numerous people come to my door and after they do the spew on their product i look at the paper they want me to sign find something in it that i don't like and kick them out, plain and simple 99 percent of them have bad contracts and i will not let them push me around, don't let them push you around. if you do happen to like what they say make sure any change is written on the paper, ie if they say something that goes against the contract make sure you have them cross out that portion and rewrite it and sign below, and get a copy while they are there, ie invest in a scanner/copier/printer, they will save your life at some point. now remember any changes to the contract on the employee might be overruled by the company but then you can take them to court and have their charges or contract thrown out, you can do this in your situation you are in now and in future ones because when a contract is signed there must be what they call a *MEETING OF THE MINDS* ie. if you do not have a this then the contract is void, if you are under the impression that the contract has changed and the company themselves is not on fault of the employee then their is no meeting of the minds and the contract is void, this also implies to the phone call, if they made it seem like it was over but it really wasn't over you had a verbal contract that didn't have a meeting of the minds.

    *just a heads up the meeting of the minds, it has to be a meeting of the minds of what a normal person would understand, so you can't go play dumb on certain things and have that work because if the judge doesn't buy it then it wont work but if the judge does understand your side and the contract then they will most likely grant it and throw the contract out.
