    Default Ex-Spouse is Suing Former Stepchild Over Student Loan Debt

    My question involves collection proceedings in the State of: Wisconsin

    My son is being sued from my ex husband, which is not his child on a college loan that was signed 6 years ago. The divorce degree put these monies as marital asset that we are both paying. Now my ex is suing my son for this loan. He is just starting out, completely shook up, since this was all addressed years prior. Where do I start. How can he sue my son when this was deemed marital asset. I would prefer him to not be involved. Not sure where to go to obtain information on what I may need, Sincerely

    Your divorce judgment is between you and your ex. You haven't told us why ou and your ex- would be responsible for the debt such that it was addressed in your judgment, let alone why it would be an "asset" as opposed to a debt. Should we guess that you and your ex- cosigned for your son's loans, your son defaulted, and that you and your ex- paid off his debt? Fill us in.
