Default Domestic Violence Charge After Mutual Fighting
my brother needs help- he and his g/f live together- sun. night they're at a bar- she's accusing him of cheating- she slaps his face- plenty of eyewitnesses- get home and still fighting verbally- he tries to exit a room and go to another- she's blocking him- he grabs her by the shoulders and moves her aside- he's lying in bed- she comes at him and slaps him again- she runs out of the room- closes 2 doors on the way- he breaks down both doors - she is on the phone w/ 911- police show up- both have been drinking- they talk to both sides- they ask my brother if he wants to press charges and he said no- she presses charges and he spends the night in jail- charged w/ dom. violence, battery- released on ROR- , which i guess is own recognisance because there waas no bail - i told him to talk to a lawyer asap- what can we expect- thanx in advance for help- this is florida - he is not to have any contact w/ her- he's staying w/ a friend

He needs to speak to an attorney and avoid any contact with the girlfriend. I'm surprised at the O/R release, though ... but, I guess FL is a little more lax on DV than many other states.

At this point, all he can do is heed his attorney's advice. The possible outcomes range from no charges filed to jail.
