My question involves guardianship in the State of: Florida
My 6 year old god son has been living with his paternal grandmother for 5 years, the grandmother has a temporary custody order. The father has been incarcerated for 3 years and will be for at least another 4. The childs mother has barley been in his life the last 5 years. The grandmother is doing her best but cannot handle him and is considering putting him in foster care. I would like to know if I am eligible to be his guardian. I only want what is best for him and I can provide a stable environment with structure. I currently have a relationship with the child and he stays with me on the weekends. The grandmother and father will sign documents stating they would like me to be the childs guardian. Currently the grandmother has a child support order against the mother, which is not being paid. I am not interested in any kind of support. The mother recently was ordered supervised visitation, which lasted a month, once a week. The court appointed supervisor advised the grandmother a couple of weeks ago that the mother will need to go back to the court to be able to see the child again. She has called once since then. The mother has arrests including, DUI, prostitution, driving w/ suspended license, drugs, etc. She recently had another child and I am not sure of her intentions with my godson, but he does not understand and deserves to have a stable loving home. If anyone can offer advice, please let me know if I can do anything to help, I do not know if guardianship, custody, etc, etc is the right way to go. Thank You
