No Time Credited for Driver's License Suspension Because DMV Didn't Get My License

My question involves a driver's license issued by the State of: PA


I have a question about a suspension. My license was suspended over 7 years ago(4 year suspension)and I went to get it back penndot told me the time never started. So in agony I filled out the form for surrendering a license and my suspension started. This was about 8 months ago. My question is about 4 or 5 years ago I had to get a pa photo id and had to fill out the form for that and on that form you have to acknolodge that your driving privilige was suspended and where the license went. Im sure I checked this box when I went to get my id. So shouldnt that be good enough as the form I signed 8 months ago(license acknoledgment form) and does anyone think I should go to an administrative hearing on this? Any hear about this situation before? I think I have a chance of getting that time back. Anyone agree?

Unfortunately, no, that's not the same as surrendering your license.

I agree with you, and I see just this situation all the time.

There is much more to it then "I filled out the form" but you can request an administrative hearing to ask for the change to your record. I would not do it alone, and I would seek professional help with the issue. You only get once chance at the request and PennDOT is not friendly to the layperson.

There could also be other factors that determine their decision, facts like where your license (the actual card) is now, when did it expire, where did you complete the application, and how was the form completed that will be a deciding factor.
