Default Re: Termination of Child Support Under New Law in Indiana of 20 Year Old

    Pandi,

I can only speak for myself. I called the Marion County (Indianapolis) Prosecutor's Office this morning (July 3rd). I was informed, the Prosecutor's Office had automatically began the process to terminate my Child Support Order & and Income Withholding Order (IWO). According to the representative, my case was processed on June 30th. He told me they (Prosecutor's Office) would send the IWO to my employer. That will direct my employer to stop deducting the amount from my paycheck. I specificially asked if I needed to send a petition to terminate. He stated, "No". One other thing, I've been subject to a IWO since 1996 and was never in arreas. Hope this helps someone.

    Pandi,

I too saw the same forms. I thought the forms would be updated automatically. Since I didn't have the $750.00 to hire an attorney I decided to call the prosecutor's office this morning. So, I called the prosecutor's office and was told they (prosecutor's office) began the process to terminate my child suport on June 30th. BTW, I'm not in arrears and been subject to an Income Withholding Order. I would call first and see what they say. The bottom line is this. It becomes a huge headache to process a bunch of overpayments by non-custodian parents who will want a refund of overpayments. So, it makes sense for prosecutors to be proactive and not have the court's packed with request to terminate child support. Don't rely on me or trust the prosecutor's office. I will keep you infomed on how my case. Stay tuned.

Very interested in the outcome of this. My order is in Indiana as well and I live in Florida and my ex and Daughter in another state. My Daughter is 18 and graduated and as i understand the new "home state" would allow my support to expire. I plan to be back in Indana late this week and would like to know what if anything came of this.

Being in TX we mailed the emancipation paperwork to the clerk's office in IN yesterday. We filed it as termination of child support 'without an agreement' since daughter and ex both want no contact with my husband unless it involves wanting money. She turns 21 in Dec and just recently we received an email stating she wanted 65% of $5000 ($3250) so she could pay off her $5000 student loan. The school year doesn't even begin until late August. We understand that funding hasn't been distributed yet for the 2012-2013 school year but already she is asking for money on a loan she wouldn't of even received yet??? She just returned from a 3 week long vacation in France so I don't know why she would be asking for money...maybe she should of saved THAT money to pay off her loan if she wanted it paid off??? hmmm....I feel more that she just wants money to pay off her trip!!! Anyway, since she is a junior now starting the university in August, even though all grants, scholarships and loans leaves a zero balance, we are anticipating if there will be a college order. But can the judge order an educational support order if there is no balance??? We will see soon....

UPDATE! After writing this I found the next 2 comments from jrob and sdlamb100. Ohhhhh how I hope this is true!!! Monday I will have my husband call the prosecutors office and see if they tell us the same!! Woo Hoo...I hope your right! At least if she petitions for a college order, the child support will be over!!!!! Please keep updated as I will also!!!

The tone and the excitement of the 2 above uninvolved third parties in this situation is disturbing...

I can imagine why these kids want nothing to do with their financial donors.

The 'excitement' as you so rudefully put it is not for supporting the adult child, but for being 'forced' by the law to support the adult child. You fully misunderstand and don't know the situation. While mom is laughing all the way to the bank with 'her' money to get her hair done, buy a new designer purse, on our dime and NOT go to the support of his daughter, well yes, there sure is excitement that she will lose her play money. If mom hadn't been so cruel as to use her daughter as a sounding block for her misery of a divorce, we wouldn't be in this situation. I have 3 kids of my own besides my step daughter. They work for their education without hand outs from us. We support them, help them and are willing to do what is neccessary to further their education. The same was offered to my step daughter. But mom made sure she didn't HAVE to work but use the support money for her personal uses and use the government to help support her the rest of the way so she didn't HAVE to work. And...she is a college graduate. But she cries poor me I'm unemployed. Right....boyfriend supports her, we support her and the government supports her. My step daughter moved out, has grants scholarships and a loan and now has a zero balance on school. But mom says she wants the loan paid off so we need to pay it off. $5000 loan...hmmm, so what did it cost for that recent trip to France for 3 weeks? Glad to see IN changed the law from 21 to 19. A junior in college needs to face the real world and work for that education rather than have dad just pay for it. Oh and BTW, we will get another email from the daughter as soon as she needs more money...that's the ONLY time she contacts us and ONLY thru emails. She won't call and won't take his calls. Glad to see child support on a soon to be 21 year old over. Time to grow up and face reality of work and responsibility.

I can't blame your husband's daughter one bit. I wouldn't speak to you, either. His child support order and his daughter are none of YOUR business. It's not "our" order or "our" money... it's his daughter, his order, his business and the relationship with HIS child... which you seem to have inserted yourself all into.

As with most subsequent relationships, perhaps dad's relationship with his child will repair itself, once you're no longer in the picture. I hope for both their sake that happens soon.

Once again someone that comments on something they know NOTHING ABOUT! For your information all of these threads were written by BOTH OF US, not that we owe you any explanation. Apparently Courtclerk you have no business on this thread since you know nothing of what you talk about. Don't judge others when you have no idea of what you are talking about. Its so sad to see others come here and judge someone with no facts and not knowing a situation. Even then, no one is asking for your opinion. This is a forum for expert advice on legal matters. You need to just move along and let people that ask for legal advice do just that. Run along and mind your own business...

Oh, rest assured CC knows exactly of what she speaks.

The opinions are, like everything else here, free.

    Consider it a bonus.

Opinions are fine, but facts are facts. If you want to place judgement ask for the facts first.
