My question involves landlord-tenant law in the State of: California
I am in a 12 month lease with my roommate and its only 4 months into the lease and he needs to go. We almost got into a fight recently because he is crazy. His name is on the lease, however he has broken many agreements on the lease. For example, we aren't allowed to have dogs and he brought one into the apartment. The dog has ruined the carpet and balcony because he is not potty trained so there are stains everywhere and it was a brand new carpet when we moved in. Also he has thrown parties here and we have received numerous noise complaints because of that. Our lease allows for us to move out if we find someone who is willing to take our place. I know people who can and are willing to take over his leave now. I don't want to move out because I found the place, the house is all furnished with my stuff, and all the bills except one are under my name (there are 4). I want to know how I can legally kick him out ASAP! I want to write up a letter as well as give a verbal notice that he has 30 days to move out but I want to be able to back it up with some legality. Please help!
