Can you tell me if an employee quits with no notice, if the company is still due to pay the sick and/or vacation time that was accrued prior to their quitting
MA law does not require the pay out of sick time under any circumstances short of a legally binding and enforceable contract or CBA that expressly says otherwise.
Vacation time is a different story. MA law requires the payout of any earned but unused vacation at the time of any and all terminations. MA law only allows use it or lose it policies for vacation time in extremely limited circumstances and only if a very rigid set of policies is in place, one of which would involve written notice of such a policy.
