    Default Subrogation for Auto Damage

    I have a question about subrogation. I am currently in the middle of a lawsuit in which we are still arguing liabillity, we are going into discovery as of a couple of weeks ago. This morning I received a call from my insurance subrogation department asking how much money out of pocket I paid for my vehicle other then My deductible because they had received a settlement offer from the other insurance. My question is if they are denying fault why would they settle subrogation? I have not received a call from
    My attorney yet and I advised insurance to contact my attorney.

    I had some accident once that was NOT my fault, the other guy was clearly at fault, said so, but because I had collision coverage, my carrier paid me for my damages right away, and then UNDER SUBROGATION, that means in my behalf, sue the other guy for damages to get back the monies they paid out to me. On top of that, my carrier then took into account my deductable, other expenses NOT COVERED under my policy, added that in, so when they get after the other guy, they are working with ONE NUMBER, i.e what they paid out, and also what I'm out. This made it easier for me, my insurance and the other guy.

    If your insurance is DENYING FAULT, then obviously they are collecting money from the other guy, and if the other guy is admitting to fault, agreeing to pay, then how would they know how much to ask for if they don't find that out from you, i.e. what you're out??
