My question involves an injury that occurred in the state of: Ohio
Today I was involved in a head on collision. The man in the other vehicle drove right into my lane and hit me head on at about 35-40 mph. Unfortunately, the older gentlemen has a medical condition which made him pass out at the wheel (he had a seizure) and he drove right into me.
I didn't realize that I had been in a car accident until I openned my eyes and there was this man knocking on my window to see if I was okay. Both of my air bags were deployed and I was hit in the head with the driver side one. I sustained injury to my arm (a nasty cut) which will turn into a scar. My breast and chest also have injuries from the seatbelt. I suffered "whiplash" due to me passing out and a busted lip, I also have a bruised rib on my right side. Right after the accident, when I was able to walk around, I noticed that I was having a lot of chest and upper kneck pain.
Everything turned out to be okay (with myself and the other driver). The x-ray and cat scan didn't reveal any life threatening injuries. After being in the hospital close to 4 hours, the doctor sent me home on two pain medications and an nsaid.
Everything seemed to be fine. Well, it's not. I am achy, especially in my chest area. I'm starting to get a persistent headache and my upper left hand side of my body is sore. I'm thinking about seeing a specialist such as a chiropractor to make sure that I really didnt' suffer anything major. The pain is persistent.
Lastly, my car was totaled.
My question is, am I entitled to pain and suffering and how much should I settle for? Even though the doctor didn't find anything wrong, that doesn't mean that something won't turn up in the future.
