    Default What Happens if the Paternity Test Reveals That He is Not My Son

    My question involves paternity law for the State of: Florida

    I gained sole custody of my 3 year old son about a year in a half ago. I have always had doubts whether he was biologically mine, due to the rocky nature of my previous marriage with his mother and the duration of time I was out serving. From birth up until now, he still does not resemble me and I have tried my hardest to not make it a factor; however, for the sake of "peace of mind", I am going to take a paternity test to determine whether he is my son.

    In the state of Florida, I need to know what my legal options or next steps are if it turns out that he is not my son since I do have sole custody?

    That depends largely on what want to do.

    Are you going to want to disestablish paternity?

    (If you are - you might find you're out of luck. If your legal paternity wasn't disestablished as part of the divorce action, you may find you're Dad - regardless. Forever).
