    Default Are Custody Orders Valid if the Case is Dismissed

    My question involves a child custody case from the State of: texas...i live back with the ex and i feel he isnt taking care of them and there are papers but the case was dismissed for not following through or showing up. Can i legally leave with my kids?

    If no custody order is in effect, there's nothing to stop you from leaving - but your ex- can go to court and seek a custody order, and it's quite possible that the court will order the children returned to the state while the matter is resolved. You had best discuss the facts and your strategy with a custody lawyer.
