    Default Can I Be Held Liable for a Fake Bid

    Hawaii, Some one hacked my computer and used my info to bid on some piece of jewelry. It was 11:00 at night when i got a call from the AAN saying that I had bid on a ring of some kind and that i would be billed. When i told them that i had no idea what they were talking about they said that I could be prosecuted criminally. I cant find the Hawaii state laws governing auction fraud online. I was hoping that some one could tell me what to do. I am a poor college student, and I have no time to deal with court over something I did not do. thank you for your help. all im really looking for is the laws involving false bids on auctions in Hawaii.

    You can search your state's statutes here (go to the left column, "Hawaii Revised Statutes", and search or browse).

    Whether there's a relevant statute? That depends upon the actual facts. "Some one hacked my computer and used my info to bid on some piece of jewelry" doesn't really tell us anything, even if taken at face value. Who? How? Why? Fill in the missing details.

    Generally speaking, a winning bid at an auction is a binding contract - no special statute needed. You may have agreed when you created your auction account that you would be responsible for all bids placed on the account - we have no access to the terms you agreed to when you signed up.

    I signed up a long time ago and I hadn't used the account in a while. I'm pretty sure that some one used my local area network. I don't know how they got my log in info, but its easy to get keyloged when receiving files through email. That's not the important part. What concerns me is the Auction network. I have no credit card or pay pal linked to the site because I was just watching for fun. when they called last night they said that their going to bill my phone. How can my phone get billed for something I don't want that I didn't bid on? Has there ever been a case of someone wining an auction and then not paying or receiving any goods, and then being criminally charged. That is my main concern. Being in college I cant have any criminal charges or I loose my financial aid. thank you for you time and consideration, i look forward to your reply.
