    Default Can My Ex Seek Reimbursement for Medical Expenses That Her HRA Pays

    My question involves a marriage in the state of:California.

    My ex and I are exchanging lists of medical expenses for reimbursement, but I've noticed that several of her expenses were paid for by the HRA she has at work. As I understand it, an HRA is funded solely by an employer - so I think she's seeking reimbursement for items that she didn't actually pay for. Is this allowed? E.g. one item on her expense list is also on a statement I received from our child's eye doctor as being paid by Blue Cross. By comparison, all my expenses were ones I either paid for by credit card or from my bank account.

    The R in HRA stands for REIMBURSEMENT. She has to pay it first, then the employer-funded HRA reimburses her for it.

    That makes sense, but if the HRA is reimbursing her full expense, I don't understand why I would then pay her for half the expense myself. Also, that doesn't explain why she's expensing an amount that a doctor's office shows was paid by Blue Cross.

    I'm not trying to explain your ex's actions; nor am I making any comment on what she can or cannot do. Family law is not my area of expertise. I'm just correcting your mistaken definition of an HRA (which I AM qualified to comment on )

    HRA is paid by the employer. It would seem that the employer would be the one entitled to any moneys recovered. This is in contrast to HSAs and FSAs where the money is the employees (set aside with tax preference). That money would need to either go back into the account, or most likely appropriate tax paid if not.
