    Angry Boundary line lawsuit in Texas because of wrong information from developer and survey

    maby to late, however i would really appreciate any info that will help me put this to bed. we purchased 3 lots in a rural subdivision total of 8.39 ac. we were given a certified survey, (plat) of all the lots in the subdivision and on the survey, it is noted that all corners are marked with an iron rod driven into the ground. we checked on all of the corners and found the iron rods. prior to closeing on the property, i specifically asked the seller ( developer ) about the old barbed wire fence at the back of the property, which was approx 10.5 ft tapering to about 4ft from end property. he advised me prior to and at closeing, that i could tear down the old fence and place a new fence, (chain Link) enclosing the area. long story short, after i took down the old fence and installed my new fence, i received a law suit from the neighbor, who previously had never said anything regarding the property or the fence, as far as i knew the property belonged to the seller. in any case i am now envolved in a law suit, as the neighbor is claiming that his father and the prior owner of my property agreed that the fence was to be the boundry line. he claims that was done in the 1960s. however, his father and the prior owner of my property are both dead, and there was never a record of any agreements documented in the courts of this alleged agreement of the fence being the official boundry line. I think he is claiming hostile adverse possession. i have an attorney, although i would really like to hear from you and get your opinion on this matter. thanks very much

    He probably is claiming acquiescence to the boundary line. Please find out, though, what theories he is arguing, as all of the well-intentioned information you receive will go for naught if it's directed at the wrong cause of action.
