    Default Speeding Ticket for "70+"

    My question involves a traffic ticket from the state of: Washington

    I was on I-90 coming from Snoqualmie where the speed limit was 70.

    I seen a police officer as I crested a hill, slowed down but it was too late and he pulled me over.

    Now I have no experience with this kind of thing, but being a minor and trying to get my Commercial Pilots License, this would be a very good thing not to have.

    I see people posting these report from the police officer but am unaware on how to get one of these. The ticket is 2 days old and I have not mailed it in yet.

    Alright before I do everything can I have someone confirm what I have gathered here? I really can't afford to mess up.

    1. So I need to contest my ticket. Now should I send it in as soon as possible, or closer to the 15th day?

    2. I also need to file for discovery. Should this be done the day I get the hearing date? Or after?

    3. Once I go to the hearing and explain the circumstances and say they do not dismiss it, can I still ask for my deferral? (When I got my last one dismissed my attorney said we would ask for a deferral if the judge didn't dismiss it)

    4. I have gotten another ticket before, but it was dismissed. Will the judge be able to see this, and possibly not allow me the deferral because of it?

    Did I miss anything?

    Currently I still have the ticket. It has been 3 days since I received the citation for "70+" in a 60mph. I received the ticket from a state patrol and is a district, not municipal ticket.

    I greatly appreciate the help you have provided. I hope I can get this resolved.

    My thoughts on when to submit the ticket are as follows. I always submit as close as possible to the 15th day. This prevents the remote possibility that *I* trigger the "filing". If you're going to contest, this is my personal way of doing it...

    1. Check the contested box on your notice of infraction, sign it, etc. Make a copy and keep it for yourself.
    2. Get your discovery documentation written.
    3. Go to the prosecutor's office and serve them. Have them stamp all three copies of the discovery.
    4. Go to the court. Have them stamp both copies. Leave one for them, and keep one for yourself. At the same time, file your contested response.
    5. Find out from the court clerk while you're there WHAT day the notice of infraction was filed with the court.

    One question I do have is this: You say you were in a 70 zone. What mile marker were you cited at? It should say on the ticket. I am pretty sure you're correct about the speed in that area. We went to the casino a couple weeks ago and it turns over to 70 just the other side of Issaquah. Is the speed listed just "70+" or does it actually list a number?

    On your last point, don't sweat it. Having a dismissal isn't anything a judge will ever look at. In fact it may not even show up on his screen.

    So you don't actually mail the citation in, but bring it in to the court with the discovery papers up close to the 15th day?\?

    And one discovery goes to prosecutors office, one to the court, and one for myself. Got it

    Ask when the notice of the infraction was filed with the court.

    To answer your question, it was a little bit before the floating bridge, I think. He cited me for "70+" in a "60" Idk if the "+" means anything.
    I will get the mile marker and more detailed info in my next post concerning the exact writing. It is incredibly sloppy though (The Ticket).

    On the Deferral, if the written report shows nothing, I can ask for a deferral at the hearing?

    I will post the discovery documentation and citation when I get home.

    Amazing how out of everything I do, this is the most nerve-wracking.

    What I posted is my personal preference. It is up to you how you wish to handle the filing of the Notice Of Infraction.

    Also, the speed limit changes to 60 LOOOONG (read: nearly 25 miles) before you get to the floating bridge.

    I know, I know.. But it is the most successful for you, and might as well since I should do the discovery thing.

    Is it ever worthwhile trying to explain how I just got laid off after the owner of my previous job killed himself, Im a pilot, im 17, no tickets, already graduated with my 2 year degree, trying to better myself. Or does that really not matter even trying?

    Explaining WHY you were speeding is admitting to speeding.

    I meant why it's important to get it removed. So one last questions (Sorry I have been busy lately)

    On my ticket, its one of the green ones and on the top right it say "I 659XXXX" Is that the Citation number than I want to use on the discovery? I couldn't find any other numbers to fill in the form Barry provided me with. Thanks

    Mail the notice of infraction back before the 15 day deadline. The number in the upper margin "I 659XXXX" is the infraction number. Check the box marked "Contested" on the back. The court clerk will assign a date for your hearing and send you a notice when and where the hearing will take place. Prepare your request for "discovery" and either hand deliver it to the Prosecuting Attorney office and the clerk of the district court or send the request to both Certified Return Receipt Requested. The court gets a copy for filing and the PA sends the the discovery materials. When the discovery materials arrive, scan and post them. Call the court clerk and ask them when the Notice of Infraction was filed.
