    Default Contractor Damaged Driveway

    My question involves a consumer law issue in the State of: NJ

    A contractor's truck damaged our driveway six months ago. We verbally agreed beforehand that he would be responsible for any damage to the driveway. At the time I tried unsuccessfully to get estimates on the repair from driveway repair companies to give to the contractor due to the backlog of work. What contractor insurance claim or legal problems will I encounter if I submit a damage claim now? Is there a statue of limitations with a contractor's insurance claim.

    If you are stating that you never even bothered to bring the damage to the contractor's attention, I expect that they're going to tell you that they don't believe that the damage is related to the work they performed six months ago. Is that what you're stating? What evidence do you have, if any, as to when the damage occurred?

    No I am not stating that, I informed the contractor right after the damage occurred and he stated he would file an insurance claim. I have before and after pictures of the driveway and of his vehicles on the driveway.

    So... what's the issue? Simply that you cannot document how much a repair would cost? You will need to do that if you take the issue to court. If you now have an estimate, submit it to the contractor and see how they respond.

    I am trying to find out the information before I talk to the contractor or insurance company. As stated above, to find out if is there a time limit on the insurance claim.

    The statute of limitations is measured in years, not months.
