    Default What Happens if I Can't Go Back to Work

    My question involves workers compensation law for the state of: California

    So if my Dr says I cant do what I was doing before what happens? I am currently on light duty and being paid by my company for same. So if Dr says I cant go back to heavy construction work then what? I know there is no other position here for me but since they have had me on light duty 1 does that mean anything? Basically I dont want to end up without money coming in. If I am understanding correct and they dont have work and get rid of me do I get disabilty? If so how long etc... Any info would be helpful.

    You find a job within your restrictions.
    it means you have a job within your restrictions.
    if they keep you in it for a year with at least 85% of you pre-injury salary, they don't have to pay a PD increase.

    you should review the fact sheet on PD from the links I posted to you in your earlier posts. it will explain the process.
    there is lot of good information on the DWC website. explore any issues you have questions about.

    So if I dont go back to work becuase they dont have a light duty position do I then get paid from disability until I find work I can do?

    you can apply for unemployment.

    I can get unemployemnt because I can work if offered work (even within my restrictions) correct?

    yes.
    you need to read about the difference between temporary disability and permanent disability.
