    Default Hit in a Parking Lot - Who is Liable

    My question involves an injury that occurred in the state of: FL

    I was recently backing out of a parking spot and was approx 1/2 way out. After making sure I was in the clear from my passenger side I glanced left to verify still clear and as I turned back to the right to continue pulling out the collision occurred. All of my car damage is to the back passenger side panel and the side of my bumper. The impact was so great that it shifted my trunk towards the driver side and caused a rippled dent on the driver side top quarter panel. We exchanged information and no police were contacted. I have filed a report with my insurance, but the other drive has not contacted his insurance nor returned contact with my insurance. Either way, my insurance is stating that I am liable although all data shows that he was driving too fast and he impacted my car. I feel that my insurance is just 'giving up' and not pursuing on my behalf and would like thoughts on whether I should push my insurance harder. Thank you.

    A vehicle that is backing up out of a space will almost always be found responsible for an accident, with most contributing conduct by the other driver being at most a factor in a finding of shared responsibility as opposed to shifting responsibility away from the driver who is backing up.
