    Default Retaliation for Taking FMLA Leave

    My question involves labor and employment law for the state of: Florida

    My company Airgas South is retaliating against after I returned from taking 88 days under The federal medical leave act.
    They are accussing of theft. with know real proof. Which by the way is a Lie. I suspect my direct supervisor is also involved. I am looking to sue them. What are my options.

    FMLA is 12 weeks of job protected leave - it seems you took slightly over 12 weeks. However, you cannot be retaliated against for taking any FMLA leave.

    I suppose you could talk to an employment law attorney & see what they think. Generally, a FMLA retaliation complaint is filed with the federal DOL who oversees FMLA.

    You may file a complaint with the federal Department of Labor if you think your FMLA rights have been violated.

    They are accussing of theft. with know real proof. Your employer is not a court of law - they don't need proof. If they suspect you are the responsible party, they may act on their suspicions. If they trumped up the allegation because you took FMLA, that's prohibited however.
