    Question Laws for Eviction of a Roommate

    My question involves an eviction in the state of: texas i live in texas roommating with an ex. Yes i should know better but now he wants to evict me and says he can give me 3 days even tho he didnt pay any of the rent and i did. Could someone please tell me what i should do? I paid the upcoming rent already and i wont be able to move for a month.can he do this? My name isnt on the lease even tho i gave him money to put on the first time of moving in here. My name was suppose to go on the lease but he didnt make sure it was and for months i thought it was. Till i asked the landlord. I stopped handing him money and gave it directly to the landlord because he kept spending my money towards his debts. Yes a big mess. But now im broke after paying rent and he wants to evict me. His reason is that i gripe. Yes i gripe about him not helping keeping the place clean and now not paying rent. I cant move in three days so what do i do in this situation?

    If you're his subtenant and you're failing to pay your rent, he can follow legal process to evict you.

    The thing is he isnt paying i am.

    The larger issue is that you're not on the lease, so he's your landlord. He can give you 3 days notice for failure to pay rent, but not because you gripe.

    Give him 30 days written notice that you're leaving, then do so. And next time you get involved in a roommate situation, make certain you're on the lease.
