My question involves name change laws in the State of Texas.
When my daughter was 1 year old, her paternal grandparents decided they wanted to be in contact with my daughter. They prompted their son to file for visitation. He had not seen her for 5 months at this time. He was not on the birth certificate and she had my last name.
When we went to court I made it clear I did not want her last name changed to his. He wanted it changed. When signing the final order, I asked my attorney if her last name had been changed. She said no.
About a year ago, when my daughter was 3, I noticed that her medicaid card listed his last name as her last name. When I asked medicaid why this change had suddenly occurred, they told me they just needed to list her as having his last name for their records. Come to find out recently, her last name was changed to his legally. She is distraught because all this time she has been going by another last name.
Is there anyway that I can get her name changed back to mine? She is now 4 and will be starting school soon so I will have to put down her legal name for them to call her by.
