Actually, you gave me the answer.
I understand that in your experience you've never come across such a thing but unless someone looks for it we can't say for sure such a case doesn't exist. So I'll look into that at the very least. If I find such a case in another state or at a federal level, would that have any value?
If by definition "temporary" is something that is to last for a limited time, the lack of a specifically defined time frame (in my mind) does not make it perpetual. I think the time limit is described as being when the road is built. My legal options appear to be to try and prove that the intent was to build the road in a reasonable time frame or find a similar case that applied a specific time limit. My other options are to reason with the owners and convince them that a land swap would be in all our best interests especially in light of the fact that they recently damaged my property and I have yet to press charges or make a claim in small claims court.
He did. I went into this with both eyes open. There are many other issues both positive and negative that I considered before buying the home. Even if things remain as they are I can live with it. I'm just seeking to improve the characteristics of the property.
