My question involves a marriage in the state of: IL.
We got divorced about 6-7 months ago. The agreement was no child support on either side, and we split the child care by taking the child 7 days, 7days off. So, it's a 50/50 split. For the past 4 months the Father has no residence in IL. He lives in another state with his relatives (he has no residency in the state of IL). He has not seen his child in this time (4 months and counting) and obviously has not followed the court order of the divorce settlement. He has not given any money for the support of his child or even seen the child. Also, the agreement was joint legal physical custody with the father being the residential parent.
What can I do to get emergency support?
Edit: The Father has not had any legal residence since the divorce.
What motions can I start to file?
1. To start supporting his child financial. What motion should I file?
2. Change the father from being the residential (since he has no residence) to the mother (who has residence).
3. Provide an order for the courts to get involved to force the father to get a job (he's been jobless for at least 3 years) and to make him start to support his child.
I'm a single mother and I cannot afford the cost of raising a child.
