    Default How Do I Get My Truthful and Complete Medical Record

    My question involves medical malpractice in the state of: Dentistry
    I requested my medical record from dentist long time ago after his failed treatment. Even 60 days of limit given by law is passed. So far I got incomplete and inconsistent medical record from him. I requested remaining critical medical records(like X-RAY) by phone and email. So far no answer. So how to get my complete record?

    Where is the state of Dentistry located? Is it anywhere near Delaware?

    Please research Federal Rules of Civil Procedure, Rule 26: Duty to Disclose; General Provisions Governing Discovery THEN research Federal Rules of Civil Procedure, Rule 37: Failure to Make Disclosures or to Cooperate in Discovery; Sanctions.

    I doubt your case is in Federal court unless you are suing for a large amount of money, but the Commonwealth of Virginia has Rules similar to the FRCP. I know this because my case is in Virginia as well. Check the Rules above and you will get a good idea of what your doctor should be doing to cooperate with discovery.

    This has not been described as a lawsuit, let alone a federal lawsuit.

    Sometimes the easiest way to get a record from a past treater is to have it requested by a new treater, and then get the record from the new guy.
