Gas Company Sent Bill from House That Was Surrendered to Trustee in 2008

Was just thinking the utility service could have found his name if his property is in fact still in his name. He had said the property was turned over to trustee. I got the feeling he thought because that happened his name would be automatically removed from public records as owner. Just some thoughts on it.

I don't know whether or not the bank forclosed on the property.

I just spoke with Consumer's and NCO today. The lady at customer service was more receptive than the BK department lady, and the NCO person said that they would instruct Consumer's to remove the old bill from my account if they can verify that it was included in my BK. I am hopeful that this will resolve the matter, but I am not certain, since Consumer's is in the process of updating their computers this weekend. I will know more by Tuesday.

Can you do a search in your counties property records and pull up your address? Trustees can do amazing things with their power however, for you to not know is well weird. Seems you should have recieved paperwork through the process of title transfer.

If you listed the gas company as one of the creditor, and it was clearly stated in the petition, there shouldn't be a problem from your end, Unless you listed it and still continue to use to the service then it's a different story, as long as after the the creditor was listed from your bankruptcy petition and the service was never use till then, I don't see any problem..

I spoke with someone at NCO again, today. She said that they would have Consumers Energy remove the account from my active account. Hopefully, this will resolve the issue. I will keep an eye on my credit reports.

Update: Consumer's agreed to remove the account. But then they put it back on again. The bankruptcy department disagreed with removing the account. I argued with someone from customer service and had a lawyer contact them. The case was referred to someone locally to deal with the matter. They never did contact my lawyer, but the lady to which it was assigned contacted me and seemed sympathetic. I explained the situation and she said that she couldn't do anything without the lease showing that tenants were living there. I was surprised to find the lease among a box of unrelated paperwork that I had planned to throw away.

After faxing the lease to the specialist at consumers, she informed me that she would remove the bill from my current account and bill the people that signed the lease! I was amazed. We'll see what happens..
