    Default Going on a Cruise While in Grace Period As an Au Pair

    Hi, I'm Japanese aupair living in the US since April 2010 in J1 status. I am going to finish my aupair year in April 2012, so my visa and DS2019 will expire. I'd like to know if I can go on a cruise to Eastern Caribbean (Bahamas, US Virgin Islands, Turks and Caicos, and Puerto Rico) while I'm in Grace period. Is there any problems when I come back to the US on cruise? I even want to travel more after cruise in the US, but less than 30 days. Do I need to get ESTA?

    If you leave the U.S. after your status expires, you should not expect to be allowed back in unless you have a new, valid visa - such as a tourist visa - or qualify for visa waiver. If you leave the U.S. during a J-1 grace period, you cannot reenter as a J-1 during that grace period.

    My travel is going to be less than 90 days, so I think I just need to apply for visa waiver. Thank you!

    We don't know if you're from a nation that participates in visa waiver, and we don't know whether the facts of your case will raise concerns at the port of entry as to whether you will leave at the end of an approved period of entry as a tourist.
