    Default Can I Be Charged Rent Past My 30 Day Notice to Leave

    My question involves landlord-tenant law in the State of: California.


    I have been renting a place month to month for 7 months, I gave notice that I have found a new place on the 12th, but the landlord is saying I much pay till the 15th (when they plan on having a new tenant move in). We have no written agreement for me renting, can he do that? I also do not have a security deposit, just a simple handshake to move in.

    (some background, we had a dispute with everyone in the house when there was a noise complaint from me to the other tenants, this is when we decided it was time for me to move. I started looking but before I found something, they said someone was interested in moving in Mid April. So I rushed to find a new place, but they've said this person could move in sooner.) I can be out as early as the 1st, do I still have to pay till the 15th? Again no written agreement, and there has not been anything agreed on for move out because the future tenant's move in time has moved a bit. At one point the landlord claimed they could charge me a full months rent for April. Help please...just want to get out of this place while loosing the least amount of money!

    You are required by law to pay through the end of your notice period, even if you leave prior to the end of it.

    You can give the landlord notice any time during the rental period, but you must pay full rent during the period covered by the notice. For example, say you have a month-to-month rental agreement, and pay rent on the first day of each month. You could give notice any time during the month (for example, on the tenth). Then, you could leave 30 days later (on the tenth of the following month, or earlier if you chose to). But you would have to pay rent for the first 10 days of the next month whether you stay for those 10 days or move earlier.

    You are not responsible for any rent after the end of the notice period, unless you do not vacate timely.
