    Default Odometer Fraud

    My question involves a consumer law issue in the State of: illinois


    i purchased a vehicle march of last year with 150,xxx miles. the dealership signed a odometer disclosure statement for title transfers stating that 150,xxx is the correct milage.however after a vin check it reveals its has almost 40k more. can this dealership reimburse all money paid for this vehicle?

    to the best of my knowledge is not a guarantee they are not wrong. It is a statement they believe they are correct.

    Unless you can show the mileage was altered while in the possession of the dealership, you have nothing.

    I would add, "or knew of a prior alteration, or had evidence of a prior alteration that they negligently or willfully ignored...."

    Do you have a statement from the previous owner? If so, what does it say?

    The prior owner sold the car to the dealership, and thus should have documentation from the dealer stating how many miles were on the car at the time of sale. If that number is 40,000 miles higher than when the dealer sold the car to you, we're on to something.

    So whatcha got?

    i am currently waiting for a reply from the previous owner. i do not have a statement from him, i am working on that. maybe a police report?

    where did you get this information that the vehicle has 40k more miles than the odometer states?

    i did a google search of the vin and the vehicle is archived on the website he posted it on. he sold on 2/24/2011 with 153k i purchased from the dealer on 3/23/2011 with 153k.
