    Default Tax Deduction when a Child Turns 18

    My question involves a child custody case from the State of: Virginia.

    My child turned 18 in 2011. I paid all child expenses in 2011 and am paying his college education. He has resided with me over 75% of the time in 2011 and now uses my address as his legal residence 100% of the time. The divorce decree has the parents alternating years to take the tax deduction. Does this stipulation change when a child turns 18 or is no longer being supported financially by one parent?

    If you want to know what the order requires, you need to read the order. If the order continues support through your child's graduation from college, I would expect that the provision pertaining to the deduction also continues through that time - but the only way to determine that is through the language of the order.
