    Default Can You Be Sued For Debts Your Ex-Spouse is Supposed to Pay

    My question involves collection proceedings in the State of: Florida
    In my divorce decree my Ex husband was ordered to pay AMEX 12M for his charges on the card with his name on it. The original account was opened by phone by me as the primary account holder. I cancelled my card with AMEX 8 years ago but they would not close the account because he still had an open balance. They not only let him keep charging, they upped his limit. All the charges were made by him while overseas and for the past 3 years they are comming after me. I have received many attempts by what appears to AMEX to settle the debt at half off, but I am afraid this is a collection agency trying to get me to reopen the case. I don't have the money to clear this off my credit report and its killing any chances of me getting a mortgage. What if anything can I do. The judge from my divorce case cannot compel him to pay since he is out of work.

    Technically this will stay on your credit report settled or not. It stays 7 yrs from the DOFD (date of first default). Now you "may" qualify for a mtg IF the lender sees a zero balance. If that is the case then settling is something to consider.

    I wish I could pay it but there is no way I can even the reduced amount.

    If your ex- isn't abiding by the divorce decree, consider exploring the option of enforcing it through the divorce court. The creditor is not bound by your divorce judgment.
