I'm on the Mortgage but She Won't Put Me on the Title

My question involves real estate located in the State of: Virginia

In April 2011, I bought a house with my girlfriend. My divorce was in the final stages and was final in June 2011. At settlement she said she didn't want me on the title until the divorce was final. It held settlement up until they contacted the lender to see if it was OK. It was and we settled. We are both on the mortgage and both been making the payments. Since then, she has said she would put me on, but she didn't do it.

Now we are splitting up and she refuses to put me on the title. Do I have any legal way to get added to the title. She did say very clearly she would do it and she never did it? Is fraud involved? I live in Virginia and the house is in Virginia.

Oral agreements to convey real estate are extremely difficult to enforce, and you don't gain marital property rights without marrying. Being on the mortgage gives you no right of ownership. If you want to try to lay any sort of groundwork to establish a legal claim, I suggest consulting a real estate lawyer to discuss possible approaches.
